Ancient Ideas and the Spectacle of the Union

It’s the Cooke and Lileks Show today! The duo delve into the egregious State of the Union address and lament the erosion of the enumerated powers doctrine. They talk TikTok and the Energy and Commerce Committee’s unanimous bill against the company’s Chinese parent ByteDance; Charles has high hopes for the upcoming SCOTUS decision that will limit or overrule the Chevron doctrine; plus James has a few Oscar reviews and an ode to old Hollywood.

– Soundbite from this episode: Joe Biden decrying the Dobbs decision in his SOTU address.

Therefore, I have just signed an executive order returning to Congress its power to legislate. Because all power in the Executive Branch stems from the Presidency, I have the sole power to eliminate any all regulations I see fit. As of midnight tonight, all regulations that have not been directly written into law will be eliminated. Any pending cases involving those regulations will be dropped by the various agencies immediately. Any attempt at a court order to stop this action will be ignored as unconstitutional. All executive power is vested in the office of the President, and no executive agency has any power other than what is delegated to it. As of midnight tonight, that delegation of power will be revoked.

Bryan, If I heard those words, I would immediately brace for the sound of the alarm clock to ruin my wonderful dream.

I suspect such a move would be deplored by those who are terribly concerned about Norms and Our Democracy, though. Unilateral! Authoritarian!

    Yeah.

Would be a great dream. And fix so so much.

I really think 4 years of it would sell the people.

Have to ignore the darn court rulings saying one could not do that.

    Thank you.

If only it could happen. Need a man like Washington who wanted to set power aside.

As long as the dream includes electing a whole lot better class of people to Congress.

There was a time when I was younger that I believed our Congress was made up of serious people doing serious things.  But that was  a while back.

But I’d settle for a Constitutional Amendment that said “No regulation issued by any executive branch agency shall take effect unless and until  affirmatively voted on by both houses of Congress”.

I’d go one step further and return more power (and money) to the states. It’s all a pipe dream, I know, but one can dream.

As much as I missed Peter Robinson and Rob Long, I very much enjoyed the “Cooke and Lileks show.” Both were in fine form. I don’t always agree with Charles Cooke in his anti-Trumpism, but I respectfully listen and agree with him entirely on federalism. His understanding of the republic’s legal history is most impressive.

I can’t help wondering what Peter Robinson, the superb speech writer of yore, thought of Biden’s horrendous rant. (Already feeling discouraged enough, I lacked the courage to do more than catch excerpts. I thought of the famous line from A Man for All Seasons: “Why Richard, it profits a man nothing to give his soul for the whole world. But for Wales?” I also thought of the line from As You Like It: “But if you swear by that that is not, you are not forsworn. No more was this knight swearing by his honor, for he never had any…”)

I haven’t seen Boys in the Boat but I intend to. What I find interesting in the Rotten Tomatoes scores is that the audience loves it at 97% but the critics not so much at 58%. People like a feel good story while the critics are always looking for something ‘different’ and ‘edgy’ and they are  especially  uncomfortable if they detect a slight whiff of patriotism.

Absolutely agree on Chevron but two other giant federal  overreaches are ‘Hate Crime’ laws and the ‘Face Act’ where the Feds can step into a local altercation and literally make federal case out of it no matter how minor. Calling names or a simple shoving match outside of a sacred abortion clinic, federal ? really?

The Ricochet podcast is starting to remind me of the Roman Triumvirates , you hear the three names upfront but over time there’s only one as the other two are dispatched offstage. let me say that I have always been a Lileksian. Hail Lileks!

Another fine podcast. James, going forward as you discover these film noire gems on YouTube and other sites, perhaps you could compile a list for us? I completely agree that there are fabulous “unknown” films just waiting to be discovered and enjoyed.

I think that’s a good Diner topic for next week. In the meantime, just wander over to YouTube and search for Film Noir – many find B-movies show up. Can’t go wrong with “This Gun For Hire” to start, for example.

Imagine if Joe Biden had submitted this State of the Union as a letter and then claimed up and down it was merely because of his grave respect for the dignity of Congress and that he didn’t want to make it a spectacle. I’d have to give respect to the wily old bastard. Or at least the old bastard’s wily handlers.

Thanks for the discussion of TikTok.  I haven’t looked into the issue and I’m aware a lot of people in Congress have said it is spyware, but really, how much does the average Congressman know about software?  Most members of Congress want us to be panicked about one thing or another.  Hearing Charlie’s take was quite useful.
