    In Virginia anyone can now use the health reason for an absentee ballot. So anyone can now do vote by mail.

    If low turnout were randomly low, perhaps not. But if low turnout is biased to predominantly exclude particular identifiable groups of voters, such as excluding elderly or excluding those with health vulnerabilities, then yes it can compromise legitimacy.

    Just stop and consider what we would think of policies that excluded black voters or excluded poor voters who couldn’t afford the poll tax. And so on. The same applies to voting procedures that are biased to exclude the elderly.

    I’m not posing the solution to the problem. (Perhaps summer voting will help. And can courts not take into account emergency conditions when weighing in on the need to change the date?) Just mainly wanted to address the assumption the biased exclusion doesn’t undermine legitimacy.
