Richard Epstein on Drone Warfare

 

Over the weekend, our own Richard Epstein appeared on MSNBC’s “Up, with Chris Hayes” to discuss drone warfare, a topic he’ll be discussing with John Yoo on the next edition of “Law Talk” (which you’ll be able to hear live right here on Ricochet this Friday). Here’s Richard on a panel with Georgetown University’s Jennifer Daskal, The Nation‘s Jeremy Schahill, and the ACLU’s Hina Shamsi.

    I must say that I was prepared for Richard’s “irresistible” delivery (as in -force versus immovable object) from regularly listening to the Law Talk podcast. Richard doesn’t interrupt others or elbow others out of the way, but when it’s his turn to speak, he delivers his point to its end, and not before. He’s a formidable advocate.

    It also helps that I basically agree with his practical but not open-ended approach to these powers. Yes it’s war, but not everything goes.

    The best part of this whole exchange is when Ms. Shamsi tells Richard “That’s not what the courts have said.” and he responds, “That’s their problem. They’re wrong.”

    Since when is The Nation considered to be in a reasonable region of the political spectrum? If you’re going to invite extremists into the conversation, why stop there? Bring in some skinheads, Marxists, and Islamists? They have opinions too.

    Or maybe I got it wrong. Is the guy from The Nation is supposed to counterbalance Prof. Epstein, that right-wing wacko? Has the ‘center’ drifted this far to the left?

    In that segment, Chris Hayes wasn’t that bad; in fact, he kept things moving, gave everyone a chance, didn’t suppress anyone. 

    I’ve seen him at other times, and he can be brutal. I can’t help but wonder if the difference was that he knew that he couldn’t get away with any nonsense, so he didn’t.

    Why have you seen him at other times? If the remote runs out of batteries, you can use the buttons on the TV.

    Well, it takes a few seconds to get the sledgehammer out of the shed before demolishing the TV. You can’t help but hear the commentary in the interim.
