Uncommon Knowledge: Donald Trump and The Supreme Court

Between now and the spring, the Supreme Court will rule on at least three cases involving Donald Trump. Two questions: What should the Court’s rulings be? What will they be? To answer those questions and more, we turn to our in-house legal experts: NYU Law School’s Richard Epstein and Berkeley Law School’s John Yoo.

    Case #1

If an unarmed insurrection exists without a congressional declaration, what do you call a million people breaking into this country with the assistance of the current president? If a blue state can apply a definition of insurrection and interfere with a federal election, why can’t a red state do the same against Biden?

I would wholeheartedly accept this argument if a state defines an insurrection and bars someone from a same state office. The federal government shouldn’t interfere in state matters unless it’s unconstitutional. The state should not interfere in federal matters as well.
