This Is Not Mutual Combat

 

Cook County State’s Attorney Kim Foxx says there is “insufficient evidence” and now Chicago Mayor Lori Lightfoot, who is a former prosecutor herself, is not happy. Foxx even cited “mutual combat” in this case, as it was reportedly gangs shooting at one another.

It happened in the 1200 block of Mason in Austin around 11 a.m. last Friday. The shooting was caught on a pod camera and police say more than 70 shots were fired. Two groups of gang members were shooting at each other. One of the alleged shooters died and two others were wounded.

Mutual combat is two or more willing combatants throwing some punches and then walking away from each other. It’s not a fight involving dangerous weapons, or deadly weapons. Mutual combat is not one individual dying, and two other participants wounded.

Afghanistan is not the only place involved in a “Forever War”, Chicago could be called Kabul on Lake Michigan. Kim Foxx and federal prosecutors in Illinois have been remiss in enforcing felony in possession of firearms laws. Perhaps they are too busy going after the real domestic terrorists, you know, like parents that attend school board meetings.

    Knowing the law and choosing to enforce it are two separate things.

    If only the combatants were involved, I might not be all that opposed to not prosecuting them, even if one of the combatants died.

    BUT . . . it is not that unusual for bystanders (some of whom might actually be innocent) to get hurt or killed in gang battles, especially if those battles include firearms (collateral damage). Mutual combatants must be prosecuted to protect against further collateral damage.

    That’s the problem right there: The last thing leftists want to do with criminals is put them in prison. They are, after all, merely “victims of society”. The result is growing numbers of people become real victims as these criminals are put back on the street to re-offend. There is also the longstanding problem of Chicago politicians taking payola from the gangs and then funneling money to the gangs for “community outreach” programs.

    “She has no clue. Assets? What assets? A phone, a gold chain, a couple bags of rock, a couple packs of refer in their pockets? A tiny bag of bullets they sell on the street? The Jordans off their feet? What ‘assets’ is she talking about?”

    It’s possible that she has no clue. It’s also possible that she knows that this is garbage but hopes to use it to deflect demands that she do something useful.

    Not sure how bad the vote fraud problem is in Illinois, but the living people who voted for these clowns deserve what they get.   My sympathies to the people who voted against these clowns and got them anyway.    Chicago used to be a really nice place to visit.     I would like to go to an audio electronics show in Chicago next spring –https://www.axpona.com/Default.asp.  However, I am not literally dying to go to the show — AXPONA is not worth literally dying to see, so I think I will pass on this trip to Chicago.

    In the introduction to historian Robert Conquest’s Reflections on a Ravaged Century, he wrote:

    “In a story by the science fiction writer Hal Clement, when an extrastellar fugitive’s miscalculation has led to his death, the comment is made, ‘Live and learn, they say…but the difficulty seems to lie in living while you learn.’ Over this century the human race has survived experiences that, to put it mildly, should have been instructive. Scores of millions have been slaughtered, and it cannot be said that the avoidance of even the worse catastrophe of nuclear war was foreordained. Have the lessons been learned? And if so, to what extent?”

    Given the willingness of so many people to vote for radical leftists with corrosive agendas, not very well. But of course part of the problem is that the professions of journalism and education have been so corrupted by leftism that many people do not know things that every citizen should know, but instead know all sorts of things that just aren’t so.

    I’ve read all of Conquest’s books. The Harvest of Sorrow about Stalin’s deliberate starvation of Ukrainians is well worth reading.

    We aren’t privy to all the facts either, but the facts we do know is that a lot of guns were fired, someone died, there’s tons of video, and Foxx is once again refusing to do the job she was supposedly elected to do. “Mutual Combatants” isn’t a blessing to settle gang conflicts in the streets. That’s almost as stupid as Rahm’s “Take it to the alley” advice. As far as we know, it’s still illegal to turn Chicago boulevards into the O.K. Corral.

    • Was there evidence of gunfire? If there’s video, charge someone with Reckless Discharge;

    • If there are guns, bullets, and brass recovered, why is Chicago spending millions on the ATF NIBIN (National Integrated Ballistic Information Network) van to not be out processing these scenes?

    • Anyone over at Foxx’s office ever hear of GSR (Gunshot Residue) testing? Tie it to the video and charge someone;

    • Video? How about some traffic charges at the very least? Or if stolen vehicles were involved, PSMV or Criminal Trespass charges?

    And we hate to be a broken record, but this situation is the EXACT reason the Felony Murder Rule was put into place: If a shooter in the car kills someone, then everyone in the car killed him. Yes, we know Foxx ran on a platform that included refusing to enforce this statute that was passed by the state legislature. For this reason alone, Foxx should be removed from office for incompetence, but there doesn’t seem to be any political will to hold a member of your own party responsible, and voters are — quite frankly — too dumb and distracted by silly blather. Foxx’s failures will continue to be measured in dead bodies.

    I’m sure there is no way that any of Chicago’s myriad felony gun laws were violated in this interaction. And, since no charges were filed, if any guns fell into the hands of the police, say from the wounded, they are returned with apologies. 

    And I hope Foxx instructs the police that if any belligerent is identifiable from the video, no selective and discriminatory searches and seizures are conducted to attempt to take away guns.

    During World War II it was estimated that 45,000 rounds of small arms ammunition was fired to kill one enemy soldier. In Vietnam the American military establishment consumed an estimated 50,000 rounds of ammunition for every enemy killed.
