In August, a jury took only four hours to review copious evidence to find Abdifatah Yusuf guilty of fraud. He owned and operated a number of non-existent medical care providers operating out of a single mailbox to steal $7.2 million from public funds. Even AG Keith Ellison praised this conviction.

However, this month, Hennepin County trial judge Sarah West has ruled that the conviction cannot stand because it was really just circumstantial evidence. The state failed to rule out "other reasonable inferences." The mind boggles. What other innocent explanation is possible from these facts?

Our new Somali friends (Remember: Diversity Is Our Strength!!) have probably looted a billion dollars from Minnesota welfare and health programs, even diverting funds to Somali terrorist groups along with conspicuous instances of exorbitant personal spending (as in the case of Abdifatah Yusuf). But the important thing is that we don't judge and keep searching for a positive interpretation of the facts.

Can the prosecutors appeal the judge's decision here?

Yes. But Minnesota Appellate Courts are not exactly MAGA territory. Then again, my guess is that they will find a way to toss her ruling because it was embarrassing even by Minnesota liberal standards.

I hope they do SOMETHING that rejects her decision. You're right: it's embarrassing!

Silly me, I assumed that the defense is supposed to offer “other reasonable inferences.” Did this guy wake up one morning and discover 7.2 million had been delivered to his mailbox. I suppose that a Martian could have been sending the money to his mailbox, but then again, the defense would have to produce said generous Martian.
