Wow! That was ... surprising. Not that Biden was not going to be prosecuted for improper possession, improper disclosure, and/or mishandling of classified documents, but how abruptly damaging that non-prosecution decision would be. That Biden would never be prosecuted --probably for anything--is not surprising. But Special Counsel Robert Hur both asserted factual guilt, and then Biden's mental incapacity as a basis for non-prosecution. "He's guilty as hell but when the jury watches Biden there will be inarguable doubt as to his ability to form conscious intent."
There is actually a difference between the capacity to form mens rea (guilty knowledge) and competency to stand trial. It is really the latter that is in play. Biden clearly is not now mentally competent to stand trial, but whether he didn't know what he was doing when he did the crime is a different question -- remember this occurred years before Biden became pResident. It is an interesting question as to why Hur (officially) projects Biden's incapacity back in time rather than the present.
At this point Biden should be saying "prosecute me!" if he wants to be re-elected -- or even stay in office through January 2025. The Basement 2024 strategy was in play. But now Hur has reframed this as incapacity. Joe cannot win without vigorous public events. But Dementia Joe really asserts himself at those events. Hur rang a bell that cannot be unrung.
President Harris, find your moving boxes.

Yes he can.
He already did.

No, the vigorous public events were by other people in the middle of the night in large cities to swing states like mine.
