It appears that our Supreme Court has gone through its entire existence without finding the need to issue the following decision.

We hold that whenever Congress uses the words male, female, man, woman, boy, and/or girl to describe an individual, it is categorizing the individual based the physical characteristics of the person present at the time of their birth. Should Congress wish to give these words a different meaning, it must do so explicitly. No deviation from the above will be presumed or inferred.

In a few months, the Court will decide two cases dealing with the subject of transgender athletes competing in sporting events reserved for women and girls.

It is time. They should include the above paragraph in their decision.

An astute reader could conclude that the above paragraph could itself be even more explicit and less ambiguous. It could, but, as a matter of maintaining dignity the court should avoid using the words penis and vagina in their written decisions as much as possible. Curiously, my first thought was that the court could maintain dignity by substituting the appropriate Latin words for penis and vagina. Alas, the Latin words for penis and vagina are … uh … penis and vagina.

I have not determined the historically correct Anglo-Saxon terms, but I doubt their use would advance the cause of dignity.

    Excellent thinking.

But several of the nine justices were appointed due to their ties to pHarma and the pesticide industries. (I'm thinking of Kagan & Sotomayor as I type.)

Pharma would be out the $400,000 per surgically altered individual if a ruling affects the numbers of individuals who put their bodies on the line and "switch" genders. Maybe SCOTUS ruling along your suggested wording wouldn't matter one way or the other. I guess it remains to be seen.

In any event, our society needs to move away from an era when elected officials proudly announce that they wouldn't and are not able to assume the ability to answer "what is a woman"?

Your wording is simple and common sense based. Two things our congressional critters usually steer clear of when legislating. Hopefully SCOTUS has more wisdom than they do.

I think sex and gender are determined at conception, but they are certainly obvious at birth. There are rare XXY, XYY, etc cases but those are indeed rare.

ALL three leftist female justices were appointed almost certainly because of their sex. None of them were the smartest of their classes, and they demonstrate that on a daily basis. Due to the blatant sexism of the Left, none of them can be truly impartial on any case having to do with sex differences or the "transgender" issue.

There shouldn't be a *need* such a decision.

Consider the more general case, where an activist group mounts a campaign to change the meanings of other foundational words to their opposites, with the assistance of the mainstream media. And the activist group and the mainstream media are funded by an enemy nation.
