Shapiro is the author of Supreme Disorder: Judicial Nominations and the Politics of America’s Highest Court (2020), coauthor of Religious Liberties for Corporations? Hobby Lobby, the Affordable Care Act, and the Constitution (2014), and editor of 11 volumes of the Cato Supreme Court Review (2008–18). He has contributed to a variety of academic, popular, and professional publications, regularly provides commentary for various media outlets, is a legal consultant to CBS News. He holds an AB from Princeton University, an MSc from the London School of Economics, and a JD from the University of Chicago Law School (where he became a Tony Patiño Fellow).

Join Jim and Greg as they enjoy two good martinis along with a crazy one. They’re thrilled with the news that President Biden and Sen. Manchin remain far apart on the massive spending & entitlement legislation and a vote this year is looking more and more unlikely. They also cheer Amtrak for announcing it will not be enforcing a vaccine mandate, the latest blow to Biden’s efforts to force private companies to demand employees get the vaccine. And Jen Psaki sets herself for another day of withering fire by insisting that we’re seeing much higher prices for beef due to the “greed of meat conglomerates.”

Big Tech, the Death of Medicine, Censorship, and Pregnancy Loss; or, How Covid Ruins Everything

 

I just got a YouTube notification that a physician I follow, Suneel Dhand, who posted a new video titled “Dr. Peter Doshi Capitol Hill video REMOVED by YouTube.” I had watched the referenced video featuring Dr. Doshi, in which he pointed out the inconsistencies in the arguments used for the current push for vaccine and mask mandates.

Dr. Dhand had shown Dr. Doshi’s video in the context of his own video raising similar concerns. Dr. Dhand is by no means “antivaxx,” but favors a multifaceted approach towards treating and preventing Covid that does not coincide with the one-size-fits-all vaccine or nothing. Dhand has also been a strong proponent of ongoing discussions in the name of scientific rigor, that there is no “settled science.”

No good martinis today, but join Jim and Greg as they react to the Biden administration urging employers to mandate vaccinations regardless of how courts rule on the new OSHA rule. They also fume as Biden considers shutting down a key Great Lakes pipeline even though energy prices are set to skyrocket this winter. And they wade into the bizarre internet guessing game of where California Gov. Gavin Newsom has been for the past two weeks.

And they fume as 13 House Republicans vote in favor of the bloated $1.2 trillion infrastructure bill and save Democrats from even more political dysfunction and embarrassment.

They also chronicle Terry McAuliffe’s blatant lies in the closing days of the campaign, from falsely accusing Glenn Youngkin of being anti-vaccine to grossly inflating number of kids hospitalized with COVID. And they fume as more than two dozen New York City firehouses went out of service due to first responders being unvaccinated.

 

QOTD: Three Generations of Retcons is Enough

 

Jacobson v. Massachusetts has become the catchall decision for justifying all kinds of pandemic countermeasures. I had not looked into the matter in detail, as I am not a lawyer (thank God). However, I ran across an article on SSRN from Josh Blackman (one of the writers at The Volokh Conspiracy) that dismantles how a decision to allow a jurisdiction to levy a fine equivalent to a parking ticket for the refusal to receive a vaccination against one of the most deadly diseases known to man (smallpox is a Risk Group 4 select agent, alongside Ebola and its relatives; by comparison, anthrax and the Black Death are merely Risk Group 3) mutated like a virus into allowing all kinds of measures under the rubric of public health.

It is perhaps unsurprising that the most disturbing U.S. Supreme Court decision to remain on the books as good case law plays a role here. Buck v. Bell is the infamous decision that allowed for the state to forcibly perform medical procedures on people without their consent to uphold the good of the gene pool, giving us the infamous line that “three generations of imbeciles are enough.” As if forcing a person to be fixed like a stray dog is not bad enough, there is evidence that Carrie Buck was not even mentally handicapped, nor was her honor student child, and she was likely set up by her lawyer, who was either horrendously incompetent or actually in favor of negative eugenics. You could use this decision to justify forced medical procedures on every person who holds a political position unpopular with political elites.

A recent stay at my sister’s home presented a microcosm of American life under the Biden regime — the new normal.

My niece told me that some of her unvaccinated friends had dined outdoors at a Manhattan restaurant. One young man entered the restaurant to use the restroom only to find an employee stationed outside the door asking patrons to show proof of vaccination before they could use the facilities.

McKenzie telling lawmakers they recommended keeping 2,500 U.S. troops in Afghanistan to avoid the very debacle that ended up happening – a recommendation Pres. Biden denied just last month.  They also hammer New York Gov. Kathy Hochul for forcing health care workers to lose their jobs unless they got vaccinated by midnight.  In addition, they cringe over Hochul saying that God wants everyone to be vaccinated her urging supporters to be her vaccination “apostles.”  And they sigh as Biden suggests we need a 97 or 98 percent vaccination rate to get back to normal.

Ron DeSantis for giving parents the power to decide whether their kids will wear masks to school in the coming weeks and shudder as Washington, D.C, allows kids as young as 11 years old to make a decision on getting the vaccine without telling their parents. They also fire back as CDC Director Dr. Rochelle Walensky admits there is discussion in the Biden administration about issuing a federal mandate to vaccine all Americans. And they chronicle the obvious mask mandate hypocrisy of D.C. Mayor Muriel Bowser.
