The Deep State Loses Again

 

Rough week for the DOJ. First, a January 6th defendant is acquitted on the legal principle that you can’t convict someone of trespassing if you let them in in the first place, and now a jury has acquitted two defendants and deadlocked on two more in the Gretchen Whitmer kidnapping plot. Specifically, the kidnapping plot that was instigated by FBI undercover agents and paid informants. One of the FBI Agents involved in the case was subsequently arrested on domestic abuse charges.  

The FBI’s conduct in this case was egregious. The FBI and its informants instigated the plot, moved to entrap the participants, and tried to destroy exculpatory evidence

Jan. 6: Pass the Fair Trial Act

Any politician or political coalition running on this plank has a real chance to win a congressional majority in 2022 and then a governing majority in 2024. The intermediate objective of breaking the deep state, and the deeper objective of restoring our constitutional republic, with its real protections against government oppression, will be advanced by a Congress exercising its constitutional authority to fundamentally reform our federal judiciary. Serious candidates and advocacy groups will press for a short, simple piece of legislation, call it the “Fair Trial Act,” abolishing the District of Columbia Circuit, dispersing the case load among federal district courts located in competitive legislative districts. This simple reform has been entirely overlooked by conservatives complaining about the stacked legal deck. Time to see more clearly and demand real reform now.

Free the Jan. 6 Political Prisoners

Despite the worst efforts of the Democrat propaganda machine (print, network, and social media), a plurality of Americans see the Americans held without bail, denied effective counsel, kept in grossly substandard conditions, and denied speedy trials as political prisoners. This should be easy for career politicians seeking to get in front of a popular position with the electorate. Yet, the silence from the Republican congressional parties in the House and Senate has been deafening. We must demand better of every primary candidate, starting with the anniversary of that infamous day.

Mark Steyn’s Motion for Summary Judgment

 

This motion for summary judgment by Mark Steyn in the case of Michael Mann v. National Review came up tonight in my Twitter feed. (Here’s a link to the PDF.)

I was woefully behind on this issue, but reading this helped bring me up to date, I think. I didn’t know a court filing could be written this way, though. It started out more like a moderate polemic, and then settled down into being very informative. It was also very readable.

Deep State Normal: FDA edition

 

distillery hand sanitizerThe FDA appeared to be forced off of its normal politics position. This banal evil institution sought to act on behalf of big corporations and the global elite uniparty in Washington DC by crippling small businesses, driving them out of competition with the big corporations. The pretense was a fee to be assessed for “over-the-counter (OTC) monograph drug” alcohol production. The alcohol was not turned into profitable booze by small distilleries. It was turned into supposedly life-saving hand sanitizer, which has almost no profit margin, if any. The fee was published and then suspended, for 2020, a day or two later. This was no mistake. Rather, it was the administrative state reasserting itself and then temporarily feigning magnanimity.

The salaried bureaucratic denizens on the surface of the Swamp, highly paid by American taxpayers at the point of federal government guns, at best did not consider the enormous human cost. After all, these forgotten Americans, from entry-level worker hauling sacks of grain, to entrepreneur owners operating with the thinnest net of credit and personal assets, are the deplorable creatures who must be broken to make a new omelet in the Great (Socialist) Reset. Crushing small businesses and their employees is entirely beneficial to normal Capital Hill politics and the RepubliCan’t Party’s paymasters.

This is why the globalist left’s Democratic Party fought for and got what it wanted in the latest federal appropriations monstrosities, while the con men and women of the RepubliCan’t party ensured that repeal of Section 230 was kept out of the must-pass bills. The rogues’ gallery, from the “Freedom Caucus” to Ted Cruz, all are on board with allowing Mitch and the California loser party leader to remain in their “leadership” positions while the enemies of our constitutional republic, Alphabet (Google/YouTube), Facebook, and Twitter, are kept in power to ensure the wrong kind of Republican is never again able to win the presidency or the Senate majority.

Thinking Outside the Swamp

 

It should be no surprise if everyone on Team Swampy gets off without even facing charges voted out of a grand jury, even if FBI agents gave away secrets to a foreign spy. To restore justice, both real and perceived, it is time for Attorney General Barr to think outside the legal swamp. It is time to make a serious case, in public and all the way to the Supreme Court, for a change of venue to a pool of demonstrably fair-minded prospective jurors.

Without this credible threat, the chance of the outside review team, leaked to the New York Times to discredit any negative findings, actually unearthing the wrongdoing of Democrats in career prosecutor disguise will approach nil. The Flynn review will produce little in the way of real justice, that is in severe legal, financial, and career consequences to the team that perpetrated this fraudulent prosecution. The wider review of political prosecutions, together with the Durham legal campaign, will produce so little as to support the DNC, deep state, and TruCon lapdogs’ claim that it has always been noble public servants standing against Orange Man Bad and his Deplorables.

The case to be made is that voter rolls, campaign contributions, and geotagged social media posts, coded for political and social views and intensity, all overwhelmingly show what “everybody knows.” We all understand that the same group of voters who put the radical Democrats into power in Virginia is conflicted out of fairly considering grand jury testimony involving Orange Man Bad. This means every single case that every social media, print, broadcast, and cable forum is demonstrably coding as pro- or con-Trump and his Deplorables.

Nikki Loves America

 

Ambassador Nikki Haley believes America is the greatest country in the world, and she’ll tell you why. She thinks well of our society and people, while being clear that she has seen and experienced real racism and sexism and that socialism is making a troubling resurgence in popularity. In her account of her time in the Trump administration, Amb. Haley raises concerns, which she raised publicly while in office, about the arrogance of mere appointed officials, carrying no independent constitutional authority or accountability, while contending that the real Donald J. Trump is always willing to listen and respects respectful, professional, direct expressions of disagreement. Nikki Haley puts this all together in a slim, readable volume: With All Due Respect: Defending America with Grit and Grace.

The title comes from a small but significant moment in the former South Carolina governor’s tenure as United States ambassador to the United Nations. She had gone out on a national show and spoken the last known administration position on new Russia sanctions. However, President Trump made a different decision when the staffed recommendation came to him, before Amb. Haley’s media appearance.

Instead of the Chief of Staff John Kelly, National Security Advisor Bolton, or Larry Kudlow simply speaking the truth, they went into avoidance mode, until Kudlow made the mistake of saying on the record that Nikki Haley must have just been confused. This painted the only woman in the loop, the U.N. ambassador President Trump had elevated to cabinet-level and given direct access to National Security Council deliberations, as confused, not really in the loop.

Targets of Another Saudi Taking Flight Training in America

 

So another young, educated, privileged Saudi man, here all nice and legal, has attempted to commit mass murder for terrorist reasons. Oh, the authorities are mouthing the usual cautions about letting the FBI get to the bottom of it, and you may believe they are diligently working to uncover or bury the truth as you will. But, the American people already have all the evidence needed to come to a reasonable conclusion. What we might not get is the fuller picture, the full target set. For that, let us turn to a parallel development.

In 1946, the United States establishing a School of the Americas, to fundamentally transform our hemisphere through the very long-term growth of professional militaries in Latin America. As the left recognized this program’s effectiveness, they organized to begin smearing our military and this program as a “School for Dictators.” The left lost this long fight, as the Colombian military became a real, capable, professional force instead of a goon squad trying to outdo communist thuggery, always a losing gambit.

Turning from that instance, understand that we have done the same thing on a much wider scale with a wide range of professional military schools for decades. The point has always been to influence foreign militaries from the middle ranks up. Yes, there are also peer militaries involved in exchanges, where we send officers to their schools and they sent to ours. Set those exchanges aside, and look at the one-way programs. No US student is going to Saudi Arabia to learn to be a military pilot. We are not just providing a service as part of the arms sales package here; we are in the very long-term business of influence operations.

Corrupt Politicians Drawn to Corrupt Country? Ukraine an Attractive Nuisance?

 

Reportedly, Ukraine has been one of the most corrupt countries on the face of the Earth. This is likely not a matter of some sort of defective national character, but rather a consequence of their geography and the past century of politics. Today, Putin, Democrats, and the US Deep State leverage Ukraine’s vulnerability to their own ends.

Anne Applebaum has done the real research and written the hard truths to power about evil perpetrated by the Soviet Union, including in Ukraine. Consider this MacClean’s interview of Applebaum on publication of her latest book, Red Famine: Stalin’s War on Ukraine.

Q: Part of the history is that the Holodomor didn’t come out of the blue. There has been a long continuity of attitude in Moscow—a contempt for Ukrainian nationalism—running through the Czarist, Soviet and post-Soviet eras. One of the more striking instances of continuity was Lenin sending in Russian troops in Ukrainian disguise during the Civil War, which almost a century later became a Putin tactic.

Framers’ Impeachment Fears Fulfilled, with a Twist

 

The current attempted coup by the unelected Deep State, now proudly proclaimed by the New York Times and leftist media people, was not anticipated by the framers of the Constitution of the United States.

The behavior now on display in Congress, on the other hand was anticipated and ultimately written off as a necessary risk that could be corrected in short order by the voters either affirming or punishing the legislators. We have this, rather than a parliamentary no-confidence vote because of the eventual balance struck, dividing power across three branches of government and within the legislature between two chambers.

We were on our way to something like a prime minister or very weak executive in the Constitutional Conventionn. Then one man, Gouverneur Morris, came to the floor of the convention and made the case for a truly independent executive.  We know his remarks from Madison’s notes:
