Nothing “jejune” about this edition, except perhaps for the first-ever use of “jejune” in a podcast, but it is the perfect term to describe Joe Biden’s “farewell address,” which, aside from its jejune content, is a most welcome sound, since he will be gone in about another 48 hours, never to be heard from again one hopes.

This week we take up three topics—one from each of the bartenders: Behold, President Biden amended the Constitution on Friday—all by himself! Aside from the obvious absurdity and low comedy of it, what does it tell us about the state of leftist presumption? Special counsel Jack Smith released his magnum opus, which seems more of a parvum opus if not an opusculum (ask your nearest Latin geek), Finally, Biden’s farewell address—and presidential farewell addresses in general—was our third topic (summary: it was absolutely Biden’s opusculum).

    The first I heard of the Inauguration moving indoors was headlined ‘ Trump,78, moves Inauguration indoors’ as if his age is the reason, so prepare for four years of Trump dementia talk.

    This is a comment pertaining to last week’s episode. John Yoo filibustered the discussion on H1B visas by repeating ad nauseum “85,000!”, the nominal annual limit. His simplistic argument was that number is a trivial amount so why should anyone care? It was frustrating that Lucretia and Steve were not prepared to counter John with more comprehensive data reflecting the actual numbers of foreigners admitted (and retained) with temporary work permissions but, why should they have been?

    John has a habit, probably learned from Democrats, of using simplistic and misleading arguments, with fervor.  When one also considers John’s headbutting with Richard Epstein on the, apparently, defunct Law Talk, John’s cred as a Conservative thinker must be called into question. My theory is John was wounded by the liberal attacks on him for his authorship of the torture memo decades ago, and decided his cushy perch at Berkeley was worth more than his principles. I wouldn’t doubt that John would sail through any Senate confirmation battles with plenty of Democratic support.

    I listened to this on Tuesday (January 21) with the benefit of knowing of Biden’s last-minute pardons of his family. Maybe you have one or more listeners in the Biden Administration who heard your suggestion of the fun of having Biden’s arrested at the conclusion of the swearing in ceremony. That would explain the very last-minute nature of those preemptive family pardons (that are so broad and sweeping that they clearly imply guilt).
