    A most enjoyable podcast, as always.

    Question for both professors:

    In the NLRB case the justices ruled unanimously against the President’s reading of his recess appointment power. However, they were silent on his rhesus appointment power. Does this mean John Kerry can stay?

    It sounded to me that Professors Yoo and Epstein were split on whether Congress had standing to sue President Obama. But if not Congress, who else would have standing?
