Richard Epstein and Adam White discuss the seemingly inevitable House vote in favor of impeachment. They debate the House’s investigation (and the investigations that preceded it), and they look ahead to a Senate impeachment trial. How will the Senate deal with factual issues? What role will Chief Justice Roberts play in the middle of it all.

@richardepstein, who called for Trump’s resignation before his inauguration, reasonably disagrees with steaming pile of bulwark writer @AdamWhite on the limits of unfair interpretation of Trump’s unrelated-to-policy statements.on

Even Richard Epstein couldn’t buy the bad faith interpretation that White pitches.

If Joe Biden weren’t running for President, it would be entirely appropriate to investigate the possibility of corruption involving his son’s relationship with a known corrupt Ukrainian business – on this point there is reasonable agreement between the two.

There was no discussion of the clear implication that Biden’s candidacy is an affirmative defense to corruption, and at the same time a (possibly rebuttable) presumption of vague impeachable offense by the President.

You can always count on Richard Epstein to provide an honest appraisal of the facts. Really enjoyable podcast.

I was also thinking that it is actually a good thing to have this investigated because he is running for office. I think it was not adequately addressed in the previous administration, as evidently were numerous ways federal institutions run (IRS, FBI, CIA) for political purposes.

How did Adam White miss Schiff beclowning himself with his parody of Trump’s phone call?
