When a nominee is confirmed by the Senate, he or she is confirmed to a particular post. The confirmation is not some kind of political Swiss Army knife, or plenary indulgence.
That’s why I’m a little skeptical of this notion, promulgated by Richard Epstein and others, that being confirmed for any position puts you in a privileged position to be temporarily appointed to a different position, relative to people who were never confirmed for anything.
