I understand the concern that mandatory minimum sentences sometimes have harsh effect. But, I am an old guy, and remember that they were put in place because many judges (the public developed a general impression that too many judges) were imposing only token punishment on many criminals because the judges would buy some pretty flaky sob stories from convicted criminals, with little or no indication that the judges were considering the victims or the general public. A large swath of the general public came to believe that judges were abusing the sentencing discretion they had, and so the public took away that discretion. I hope the current proposals include some mechanisms to ensure that judges don’t again abuse their discretion.
