Okay, I listened to Law Talk. John Yoo confirmed that John Podhoretz didn’t seem to know what he was talking about a few episodes ago with Chief Justice John Roberts (too many Johns in this sentence) allowing state judges to determine how elections are run as that power to granted to state legislature — not state judges and courts.
I think this is what he is talking about.
In Pennsylvania the state legislature wrote the law, but the courts decided to change the law as they desired for partisan purposes.
