On the Election Day podcast, when it’s all over but the results, we stop the punditry and look back to elections past with our friend Daniel Casse, veteran Republican campaign hand. What happened with Clint Eastwood and the empty chair? How about Chris Christie’s entourage? How Bob Dole chose the seating chart on his plane? And lots more. Give a listen.

Okay, I listened to Law Talk.  John Yoo confirmed that John Podhoretz didn’t seem to know what he was talking about a few episodes ago with Chief Justice John Roberts (too many Johns in this sentence) allowing state judges to determine how elections are run as that power to granted to state legislature — not state judges and courts.

Article I, Section 4, Clause 1: “The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of choosing Senators…”

I think this is what he is talking about.

In Pennsylvania the state legislature wrote the law, but the courts decided to change the law as they desired for partisan purposes.
