We Must Honor the Imperial Presidency

Ruling that Detroit’s federal bankruptcy filing violated the state constitution, Judge Rosemary Aquilina, an Ingham County Circuit judge, made these unbelievably creepy statements:

“It’s cheating, sir, and it’s cheating good people who work. It’s also not honoring the (United States)…

    I may be wrong, as I don’t practice in this area, but it seems to me that the supremacy clause would prohibit the application of state law to prohibit any person or entity from seeking relief under a federal statute. 

    Am I missing something?

    We’re in a crazy world where leftists are getting aggressive in being able to hold simultaneously contrary beliefs.

    She at first appears to be asserting that she is a Scalia-like textualist, admonishing that the the Governor: “reads certain sections of the (Michigan) constitution and reconsiders his actions.”

    Then she gos off on her Führerprinzip bit.

    Okay, stupid question here. I read the comments at the link and one guy mentions that the union members paid a lot of money into their plans that they should get back. 

    How is the Detroit bankruptcy related to the auto union bailouts? I’m assuming the public sector workers (chiefly defined benefit pensions?) in Detroit will be compensated through their national unions whatever the condition of the city. But, how do the auto workers factor into this, given the federal bailout? Do they have defined benefits we’re all on the hook for, or have auto unions modernized and their members now make contributions to their retirement like the rest of us?

    More attempts to deny reality. Either the city is bankrupt or it isn’t.  If Detroit is bankrupt (and there seems to be plenty of evidence it is) then either someone is not going to get paid what they are owed OR someone else is going to pay it.

    The liberals of course expect someone else to pay it. Someone being you.

    She also ordered that a copy of her declaratory judgment be sent to President Barack Obama, saying he “bailed out Detroit” and may want to look into the pension issue.

    Surprisingly many, in my experience.  You don’t need brains to become a judge.  You need political connections.
