That’s Why It’s Only Called an Analogy

Senators in an impeachment are not like jurors. That courtroom analogy is only useful up until the point where it is not useful anymore.

An actual jury selection allows for the rejection of any prospective juror for bias. By that measure, every one of the 100 Senators would be dismissed for cause. But the Constitution doesn’t allow for rejection of any Senators in trying an impeachment. That’s because impeachment is a political process, not a legal one. The analogy that equates the two is flawed and breaks down at this point.

That is why Nancy Pelosi was right when she said she wouldn’t proceed without bipartisan approval, and why she was wrong to proceed when that bipartisan approval was not forthcoming.

the point of any analogy or law or rule or points of order or tradition is to impeach Trump.  As long as these things support the impeachment of Trump they are ironclad.  If they do not support the impeachment of Trump then they can be disregarded or ignored.  All that matters is the impeachment result.  Nothing more.

Impeachment is just payback to him for being elected in the first place. I saw a yard sign today “Any Adult for President, 2020.” Then there was a substitute host for the Glen Beck show on this morning, who listed all the ways that we are far better off from the Trump years, which too many people never hear about. Are Dems really going to run and tie their future and ours to one of their socialists who starts from the premise of immense misery requiring that we throw out our whole system? While being the party that actually DID use foreign-produced materials (Christopher Steel) and withhold funds for the gain of the VP family (Biden and Hunter)… then projected it onto the other side when they should have been the ones investigated?

I have to pray for “Every Adult needed to vote, 2020,” but such a sign would be incomprehensible to that neighborhood.

JesseMcVay: Senators in an impeachment are NOT like jurors

A better analogy would be like judges.  A very large bank of judges.

Awesome. Too many people see analogy as equivalence.

It is both. It is directly authorized by the supreme law of the land (the Constitition) and has the legal consequence of removing an official from office, even if the process is more guided by political agreements and theatrics.
