Joe Biden Declares That He Is Now Emperor of the Moon…

 

…in other news…Biden says that states have ratified the Equal Rights Amendment to the Constitution. The nitwit Vice President, Kamala Harris is also celebrating the news.

It’s not April 1st. The Equal Rights Amendment has not been ratified and isn’t likely to be. President Biden doesn’t possess magical, extra-constitutional powers. Recommendations have been made that Joe Biden be given a broom to sweep back the ocean when not napping on the beach in his post-presidential years.

    The National Archives told the Daily Caller News Foundation on Friday that it maintains its position that the Equal Rights Amendment (ERA) is not part of the Constitution — even after President Joe Biden’s declared otherwise.

    “This is a long standing position for the Archivist and the National Archives,” a spokesperson for the National Archives said. “The underlying legal and procedural issues have not changed.”

    Still expecting blanket pardons for illegal entry into the country or remaining illegally. If those things aren’t crimes, then mass deportation is more difficult.

    To see what non-conservative media was saying, I checked CNN. The attitude of the CNN article is that it is a serious position.

    The CNN headline says President Biden’s statement kicks off an expected legal battle. I don’t see why it should. 

    The article quotes a “senior administration official” that President Biden is not taking “executive action” but is expressing an opinion, and that the opinion is consistent with opinions from “leading constitutional scholars and the American Bar Association.” I have not looked for those opinions from “leading constitutional scholars and the American Bar Association,” though I note that the ABA is a clearly political organization.  But CNN’s article proceeds to treat the opinion as serious, but subject to countering opinions. 

    But what Biden said is just Joe Biden’s opinion, entitled to the same weight as my opinion. That he is nominally President of the United States adds nothing to the power of his opinion on what the law is. 

    As President he could take executive actions based on his opinion, but he would be acting contrary to multiple government legal opinions. Biden’s opinion is that a vote in 2020 sealed the ratification. Well, if he really believed that, why has he waited the full length of his term as president to say anything or do anything?  

    CNN does not explain its headline comment that Biden’s statement will kick off legal battles. Nothing changes because an old senile man expresses an opinion.

    The CNN article does mention a couple of times that this is part of the push to codify abortion.

    The article does also suggest this opinion of Biden’s is among many of the things the Biden administration is doing to make life as difficult as possible for incoming President Trump.

Therefore on Jan 22 they can be deported because they broke the law again.  Just like pardoning someone for murdering someone in 2024 doesn’t make that person immune to prosecution if they murder someone later.

    Or if they murdered another person at the same time, but hadn’t yet been prosecuted/convicted for it.  If they’re pardoned for A murder, they’re pardoned for THAT murder, only.

    Opposition to the amendment 40-50 years ago was based on the realization that the courts would use it to do all kinds of things that weren’t even related to its meaning. But back then no one could have dreamed that one of those things would be to use the phrase “on account of sex” to apply to transexuals. And that even some conservative judges (Gorsuch) would agree with that. That’s why they want it so bad now. I would like to see a new amendment which says the same thing but which uses clarifying language to make it mean what it meant when it was written.
