Several Counties in PA Breaking the Law for Senate Recount

 

Just when you thought Dave McCormick was the new duly elected Senator from Pennsylvania…county commissioners in Pennsylvania have decided to violate state law to swing the election to Bob Casey.

From The Daily Caller:

Bucks County Commissioners Diane Ellis-Marseglia and Robert Harvie moved to allow for undated or misdated ballots to be counted in the crucial swing county, despite a Nov. 1 state supreme court ruling that undated or misdated ballots cannot be counted.

Other counties in the state — including Centre County, Philadelphia County and Montgomery County — have also moved to allow undated or incorrectly dated ballots to be counted, according to The Philadelphia Inquirer. The Bucks County GOP said in a post to X that it is working with attorneys from the Pennsylvania Republican Party and the Republican National Committee to address the situation in Bucks County.

Doesn’t a violation of state law require law enforcement to put a stop to this?

Does Governor Shapiro care or is he encouraging this violation of law?

    BREAKING:  Pursuant to an emergency filing by Casey attorney Marc Elias, the PA Supreme Court has ruled that ballots stored in vans, semis, and passenger vehicle trunks  parked within three blocks of a designated ballot collection/deposit location discovered within 30 days after the election must be counted and do not require signatures.

    Satire–or is it? 

    We are approaching a Gregoire/Franken/Gore in Florida recount overtime in which the rules are (1) GOP ballot counts do not increase (2) Democratic ballots must continually if somewhat mysteriously increase and (3) the process must continue until the Democrat wins.  If SCOTUS had not ended the circus in 2000, Gore could have won on the fourth or fifth recount under new and exciting interpretation rules for bad ballots.

    If the new GOP congress and a GOP DOJ does not prioritize election integrity legislation and go to the mat with Democrats who will certainly regard this as a death struggle, this criminal behavior will cancel majority rule.  Even though I frown on non-germane amendments and grab bag legislation, election integrity requirements should be attached to every spending bill until a filibuster is too painful to maintain.  I want deep dives into suspect registrations and J6 sentencing levels for anyone and everyone caught abetting cheating.

    1.  This action by Democratic County officials shows that they don’t believe that Democrat voters are as competent or able to follow instructions as Republicans.

    While some attendees and participants in the meeting argued against counting undated or misdated ballots by citing case law, Ellis-Marseglia said that “precedent by a court doesn’t matter anymore in this country” because “people violate laws anytime they want.”

    So much for the oath of office to uphold and defend the United States Constitution.

    Also any judges that go along with it.  Judges might be immune from civil lawsuits, but they’re not immune from criminal prosecution.

    I think it’s fascinating that we are all witnessing an attempt to steal an election using illegal ballots in real time – not after the fact when those who have flagged it can be smeared as election denialists – and the major news networks are silent about it.

    Yes, Republican attorneys have filed a lawsuit to prevent the inclusion of these illegal ballots in Bucks County but it’s unclear whether similar lawsuits or injunctions have been filed in the other more populous counties…so there’s still the chance that illegal ballots (and potentially fraudulent manufactured ballots) will be merged with legal ballots and then difficult to extract. If that happens a judge or panel of judges may have to rule whether the recount was legal and binding or whether the initial ballot count should be the final count if the pool of ballots counted has been polluted with illegal ballots. Or Casey may be declared the winner.

    Someone from the Trump organization and Sen. John Thune would be wise to get to the airwaves and make this a lead story.

    One of the guys on the Three Martini Lunch podcast today (I can’t tell them apart) diagnosed this, I think perfectly, today as a tantrum by the woman Commissioner, who based her screed on two points: One, that we’re in a world where legal “precedent” doesn’t matter anymore.  That’s her Dobbs decision, abortion, tantrum.  Two, that we’re in a world where criminals don’t pay any price for their crimes** That’s her, “not only couldn’t we put that SOB in jail, he’s just been reelected President of the United States” tantrum. She lost, she’s just trying to exact payback, and doesn’t care what she has to do to get it.  Because she knows she’s on the right side of history.

    It’s hard to imagine, now that one a Democrat functionary is on the record, boldly admitting to these sorts of illegal shenanigans and saying that she doesn’t care, she’s going to do them anyway, and count whatever votes she wants, and maybe some other counties will as well, that this won’t throw fuel on those fires still burning that something was hinky in 2020.

    One of Pittsburgh’s two papers mentions, more in sorrow than in anger, that the recount difficulties stem from “unresolved ambiguities in PA election law,” rather than this specific matter. Neither of them mentions the PA Supreme Court decision, or the Bucks’ County Commissioners flouting of it.

    I hope someone, somewhere, is paying attention.

    **For some reason, seeing a Democrat complain that we’re in a world where crime is treated with impunity–as if that’s a bad thing–strikes me as quite rich.

    In noting the irony above, I was speaking less about specific political crimes than about the tendency, often via Soros adjacent prosecutors, to refuse to round up, try, and incarcerate both non-violent and violent criminals all across the country, thereby turning pockets of it into lawless hellscapes.  Democrats have, at least until now, largely closed their eyes to the matter, supporting campaigns like “Defund the Police,” cheering on and raising money for violent riots and destruction of life and property on behalf of the “right” causes, and  insisting that rounding up, trying, and incarcerating all such criminals, and many other violent perpetrators is racist.  It is that “impunity” on the part of Democrats with regard to properly dealing with crime and criminals, which is destroying the quality of life in many parts of this country, that I was speaking about.

    She was not charged, because the system protected her.

    Obviously, and Comey’s excuse for not charging her set records for stupidity. As kedavis said, others (including me) pointed out at the time that there is no element of intent in the law for mishandling classified material. Everyone who has ever been cleared to handle such material is required to have read the relevant law.

    Yes, I certainly believe Josh Shapiro is aiding this effort. In addition, it appears he has supported this behavior in the past which I reference in an over lapping post. Shapiro seems to be benefiting from this image of him being a centrist and a moderate fellow. This is not the case. He may have a mild exterior and moderating speech, but he has proven himself to be otherwise behind the scenes in his political maneuvering – he’s a bit of a wolf in sheep clothes.

She needs to be arrested and escorted to the Bucks County Jail. Regardless, come next election she will be out of a job. BTW- one the Bucks County residents at this meeting cited the laws she may have violated and said she is bringing a lawsuit against her and the county supervisor who seconded her motion to count illegal ballots.
