SUPREME COURT OVERTURNS ROE v. WADE

 

The Supreme Court of the United States has overturned the landmark Roe v. Wade decision, ending a 49-year-long interpretation that abortion is a constitutional right. Now individual states have the power to allow, limit, or ban the practice altogether.

“We end this opinion where we began,” Justice Samuel Alito wrote in the 6-3 opinion (PDF). “Abortion presents a profound moral question. The Constitution does not prohibit the citizens of each State from regulating or prohibiting abortion. Roe and Casey arrogated that authority. We now overrule those decisions and return that authority to the people and their elected representatives.”

The case decided today was Dobbs v. Jackson Women’s Health Organization, which focused on a Mississippi law banning abortion after 15 weeks of pregnancy. The state asked the Supreme Court to strike down a lower court ruling that stopped the legislation from taking effect.

Justices Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett joined Alito’s opinion. Chief Justice John Roberts agreed with the result but filed a separate opinion. Justices Stephen Breyer, Sonia Sotomayor, and Elena Kagan filed a joint dissent.

In addition to ending Roe (1973), today’s decision also overturned Planned Parenthood v. Casey (1992), which re-affirmed abortion as a constitutional right.

    I never want to be too optimistic, but it seems that the last two decision, Roe and the New York gun issue, have joined in with the election of Youngkin and other notable refutations of the out of control Left to say, Enough is enough! and begin the long overdue reset in this country. We can only hope that this is not a notorious “dead cat bounce” as the nation slips into irrelevance, having gone too far for redemption.

    Donald Trump deserves massive praise for sticking with Kavanaugh. He deserves credit for the 3 justices that joined Alito and Thomas. Credit to the Justices for the decision. Credit to McConnell for holding the seat.

    If nothing else came of the Trump presidency, this was worth it. It was worth all the drama, mean tweets, silly statements, hand wringing, all of it. I’d pay 10x that to have this outcome. Trump’s presidency was overall great policy-wise, but this will be the central pillar of his legacy.

    This is the biggest pro life win since Roe. Now the battleground shifts to 51 smaller battles. Keep up the good fight.

    Credit to RBG for not retiring and letting Obama appoint her replacement.

    ‘Notorious RBG’ got too full of herself with her doting fans cheering her on as some demigod.

    I looked at the opinion briefly, but didn’t focus on the majority argument.  I checked the concurrences by Thomas, Kavanaugh, and Roberts.

    Thomas and Kavanaugh joined in Alito’s majority opinion.  Roberts concurred only in the judgment.  Roberts did suggest that he thought the decision was correct, but wanted a narrower ruling that would resolve this particular case without completely overruling Roe and Casey.

    Yes. Watch and then Compare/Contrast the behavior of the Left to the behavior of the Right when faced with a SCOTUS decision they didn’t like (Dobbs 2022 versus Roe 1973).

    Be prepared to hear “mostly peaceful” until you vomit.

    No, he concurred in the upholding of the MS law, but stated in his concurrence that he would not have gone so far as throw out Roe and Casey.

    There will be more illegal abortions and there will be moves to expand the court.  Nothing is easy but some things are essential.   Giant companies are already offering to pay  for folks, presumably employees, to travel for abortion,   but most folks wanting abortion aren’t employed in these companies.  All of the aggressively pro abortion companies are  giant and they also support centralization.  So perhaps more folks will come to  understand that these companies are a threat to the US constitution and US citizens.  Clear decisions are important.  I’d guess that rather than lead to expansion of anti abortion it will in fact tend to lead to clarification in all states.  Clarity is always good.  The Supreme Court did its job.  I hope we don’t undo that vital institution because of a sound decision.

    If the feds won’t protect the justices, businesses and homes, and the local police can’t handle disturbances, I hope the governors will call out their National Guard or the State Guard, which I recently learned can also help.

    1.0 We are going to be hearing about mostly peaceful protests

    2.0 The MSM and the DOJ will continue to ignore the attacks on pregnancy resource centers

    3.0 There will be a push for packing the court

    4.0 There will be attacks on Catholic Churches, Orthodox Synagauges and Evangelical Churchs and MSM will not consider this a hate crime

    Same. I had a hardcore Democrat feminist friend who was a lawyer (probably still is, though we’ve fallen out of touch), and she would repeatedly state that Roe was really bad law.

    “I trusted Justice Gorsuch and Justice Kavanaugh when they testified under oath that they also believed Roe v Wade was settled legal precedent and I am alarmed that they chose to reject the stability the ruling has provided for two generations of Americans.  

    “I support legislation that would codify the rights Roe v Wade previously protected.  I am hopeful Democrats and Republicans will come together to put forward a piece of legislation that would do just that.”

    Huh?  Didn’t Manchin say he was pro-life?

    John Roberts essentially took the position that the court could uphold the Mississippi abortion law while still saying that Roe v Wade hasn’t been overturned.

    Quite to the contrary, I never assumed that the Left would rollover and play dead. However, I don’t believe that the vast majority of Democrats are leftists. My experience with them is that most are far more centrist, as are most Republicans. A  lot of both sides are totally disgusted with the extremes on both sides, but the Left has been dominant in the news and through their idiotic CRT, BLM, and Antifa support. They have very likely made many of the Democrat voters unwilling to support their candidates. They may not vote R, but they may well stay home. I do think that the Progressives will continue their idiocy which is fine with me. Let them rant, rave and riot. It will only add to our support and tend to move the country to the right where we have been through most of our history.

    In San Francisco, a city where Trump got 12 percent of the vote, about 60 percent of the voters voted to boot out the Leftist District Attorney.  And the school board reversed an earlier decision.  Now they are back to merit based admissions for Lowell High School.

    The Left is driving voters away.
