I wish it were otherwise, but I fear that Richard's prediction will come true. The attitude of dependency has become too pervasive. His analysis of how the waivers work was devastating.

I've watched a lot of episodes of Uncommon Knowledge, both on television and then on the Web, with Mr. Robinson interviewing people who were sharp, aggressive, august, initimidating, and -- in one particular case (yes, I'm thinking of someone whose last name begins and ends with Vidal) -- downright insane.
But I don't think I've ever seen him so guarded as in this one. Having listened to all of "Law Talk," it is certainly warranted. :-)

The Conservative Justices of the Supreme Court are the Battered Bastards of Bastogne. The Republican Primary Candidates must break out of their Romnesia and start talking like real Conservatives to relieve the pressure.
Obama bringing the Obamacare case to the Supreme Court early is the German sneak counter-attack of the Battle of the Bulge. With the in fighting between Romney and the rest, the Obama gang hopes to catch the Republican Party off guard. The slim majority on the Supreme Court is susceptible to political considerations. If the Republicans look weak the Court might back off and let Obamacare happen. If the Republicans look strong and with Richard Epstein's surgical strike on the mandate, the Court will blow Obamacare out of the water. Even if it's only 5 to 4 who cares!
Here are the Conservative Republican Candidates racing to relieve the Court.

Richard's point about "government by waiver" undermining the rule of law is an excellent one, and that argument should be made more loudly by those on our side.
Every time Obama or one of his surrogates makes the outrageous claim that his government is just trying to secure a "fair set of rules" that everyone has to play by--regardless if they're in the 1% or the 99%--we must hammer home the point that Obama has increased the discretionary power of un-elected administrators and exacerbated the problem of regulatory capture through the two most sweeping pieces of domestic legislation that he has signed into law (PPACA and Dodd-Frank), and through every single one of the agencies that he oversees (most egregiously, perhaps, at EPA).

I get the feeling that Richard luxuriates in complex issues, and matters of clear moral argument would leave him rocking in a corner lamenting the waste of his unused synapses.

at about the 57-minute mark, Richard Epstein describes what is at the core of the state of the union. Then PR asks, "Is there any way back?"
I wish John Yoo and PR would have let him finish what he was saying.
I presume to believe it is the same as this paragraph from a post I'm drafting for the Member's Feed:
Charlie: "This is the conservative message that needs to be propagated: Freedom leads to prosperity but also disparity. This is far superior to the alternative: coerced ‘fairness’ that entails less prosperity. The job of pundits is to learn how to articulate this, as Thomas Sowell [and Richard Epstein, I might add] does the most impressively. The job of politicians is to learn how to persuade individuals to accept the disparity that comes with freedom and appreciate their own prosperity without resentment for those more successful. Prove it, articulate it, and above all MAKE people who don’t already believe it change."
