So the Twitterverse is ablaze with news that USDA employee Shirley Sherrod intends to sue Andrew Breitbart.

Hunh? On what grounds?

On the grounds that he's the most hated conservative in the country next to Rush Limbaugh. And "lawfare" is an effective way to stifle his voice.

The Week has a nice little roundup from back when Sherrod was merely toying with a suit. On the left, Firedoglake has Obama's measured reaction. On the right, Stacy McCain scoffs.

My question is simple. Even if Breitbart was the precipitating cause of Sherrod getting the boot, isn't the proximate cause a spasmodic and hasty set of public officials? It's one thing to get fired from your private-sector job because your name has been dragged through the mud. It's another to get fired from a government job because the higher-ups took ten seconds to run the political calculus and took drastic action. Doesn't she have a stronger, better case, on a different cause of action, against the government?

She will likely allege defamation, but because she is a public figure, it will be tricky to show malice. Especially since Breitbart's post refers to her more in passing as he focuses on the NAACP.
