The Ricochet Line of the Day

Richard Epstein:
The trouble here is the conservatives [that is, conservative justices on the Supreme Court] tend to believe in judicial restraint while the liberals believe in the statute. That tends to allow a lot of legislation to go through.

One side is results-oriented, the other respects process.
Sometimes it is easier to be unprincipled.

Duane: Speaking very generally, one area where it seems conservatives could be both principled AND active and results-oriented is, when original intent and precedent are in conflict--as they often are, to side more with the former. We're getting a wee bit better in that area of late (Citizens United), but I think even more audacity is in order, even if harrassment at SOTU speeches is the result. We can take it.

Re: The Ricochet Line of the Day
I hear you, Scott, but CU is one small step off-center for my taste. I prefer issue-specific advocacy about major matters (such as education or health care) or broader, clearly center-right mainstream think tanks (for me, AEI, Hoover, of course, and locally the Center of the American Experiment).
Now, don't know how CU fits this one, but a bunch of conservative groups turn me off by mail- I also stay far away from any group that does gimmicky, expensive fund-raising, such as direct mail with enclosed trinkets, etc. That doesn't strike me as efficient stewardship.
I wish them all success, as long as they don't get too strident or pedantic about certain specific issues.

Duane: I think either you read my post too quickly or I wasn't clear (probably the latter): I was talking about conservative jurisprudence and the recent case involving Citizens United, not the institution, about which I know nothing. By "audacity," I meant the guts to overturn precedent, as in that case, which I'd like to see more of.
