While I am glad that John Yoo won his case in the Ninth Circuit getting qualified immunity, I am disturbed by the roadblocks the government grants itself and employees for true abuses of power. Look at the Wilkie Supreme Court case where government employees abused the poor Wilkies, complete with bogus criminal charges, all for the purpose of intimidating the Wilkies into granting the government an easement (which the government could have simply taken, but that would have been an embarrassment to someone who screwed up in the first place by not recording a deed).
I have personal experience with illusory government remedies, forcing citizens to go to court in Washington (Court of International Trade) for matters within its exclusive jurisdiction, which is not clearly defined, resulting in confusion about where to file and the certainty of facing a jurisdictional motion to dismiss no matter where one files. Some laws require the government provide certain safeguards to citizens, but allow no remedy when the safeguards are not followed. See e.g., United States v. James Daniel Good Real Property, 510 US 43 at 64-65 (1993).
Our government have become tyrannical. We need remedies.
