Sweet Dreams
Just about to turn in here in Dallas--details soon on the reason for my quick trip back to my adoptive home state of Texas. (If that's the right way to put it. When Gov. Perry named me an honorary Texan, come to think of it, Texas's adopted me, not the other way around.) Googling around just now--which is, let's face it, about all there is to do in a hotel room--I just came across the item below.
I only hope my beloved friend Paul Rahe--for whom, I know, you all join me in offering up a prayer--sees this before turning in himself.

If the whole "Patient Protection and Affordable Care Act (PPACA)" is thrown out immediately, or it eventually falls apart, after it loses its mandate power, I think some Catholic bishops will be a little disappointed. They didn't get the opportunity to go to jail for noncompliance with the contraception mandate. :)
No dramatic and historic letters from jail. Oh well....

As I said on another thread, I was very bullish on the mandate going down (indeed, the whole law going down) until several things I read on Volokh and in the survey of former clerks about the happy, pleased demeanor of the liberal justices over the last few weeks. One of the former clerks noted how mild the liberals have been in their dissents and questions in other cases and thinks that means they can afford to be magnanimous since they got their way in the big one.

Whatever happens tomorrow, it's lose-lose for Obama. The best possible outcome for him is the striking down of the mandate only--and that's still very bad. If only the mandate goes, then he can, at least, pretend/wishcast there's some alternative funding possibility to save the rest of the distaster.
If the whole thing is killed, then he looks like a total fail. His signature initiative is gone, and his judgment looks like a zero--he will be campaigning with the lower half of his political amputated.
If the entire thing is upheld, then his political death sentence is postponed, but those who detest him will work that much harder, and those on the fence will have that much more to think about between now and November. But again, he looks bad whatever happens--it's close to being a tossup vis vis his reelection chances--an enjoyable silver lining to the horrible "executive" he is.
