As John himself noted below, yesterday the Ninth Circuit ruled--finally--in his favor.  From an editorial in the Wall Street Journal:

How baseless was the persecution of John Yoo by the white-shoe legal elite, which peddled the claims of a terrorist in order to harass the Bush Administration lawyer for his national-security views? So baseless that even the Ninth Circuit Court of Appeals has thrown the case out.

I'd add, if I may, a personal note.

I've known John since he returned to California from Washington almost ten years ago, and I've found myself marveling at him again and again.  Not since the treatment Ed Meese received during the nineteen-eighties has a public official been so relentlessly, viciously and unfairly vilified--if anything, John has been subjected to more vicious treatment than was the former attorney general, and the vilification John has endured has lasted much, much longer.  In all the years I've known him, John has never--never--betrayed any resentment or bitterness whatsoever.  None.  To the contrary.  John has always proven a man of inexhaustible good cheer, optimistic, full of good humor, and, despite all he has had to endure, happy.

Congratulations to John, a brilliant lawyer, a superb teacher, an accomplished author--and a cheerful patriot.

I'd like to congratulate John Yoo not only for beating a baseless lawsuit but also for that time he went on the John Stewart show and made Stewart look foolish.

That was a stellar accomplishment, and I don't think it has quite received the renown it deserves.

John it would be a fitting conclusion if you were able to go back on John Stewart's show. Congratulations, you've earned the accolades and I greatly admire your magnanimity in the face of calumny.

It's funny, I watched this the other day just for giggles. I think I'll do it again now...

John and Jose Rodriquez remind that e pluribus unum is indeed a great heritage to celebratate.  What great patriots!

Thank God we have Americans that step up and perform to protect us.

This is great news.  I had the pleasure of attending a talk John recently gave to the Federalist Society in New York.   There were, of course, hecklers who inflitrated the event.  John handled them with more grace and good cheer than I thought possible -- certainly more grace than I would have displayed.

Congratulations, John!

Wonderful news indeed.  No doubt at all that you have the gratitude of the Ricochet family - and a multitude of other Americans -  for the work you did while with the Bush Administration.  As with others, I never miss the Law Talk podcast.

And thank you, Peter.  That is a nice tribute to John.  He deserves it.

Yoo Hoo, too!

John is just an all around great person. Brilliant, kind, great sense of humor; the complete package in a human being. And how great is the podcast? It's the best thing to EVER happen to legal discourse in this country. There isn't even a 2nd place. Congratulations John!
