Professor Richard Epstein gave his thoughts on the Atlanta hearing on Obamacare earlier. It's also worth noting what the mainstream media and others are saying. Here's the Los Angeles Times headline:

Judges sharply challenge healthcare law

Skeptical questions from three federal judges in Atlanta suggest they may be ready to declare unconstitutional all or part of the healthcare law promoted by the Obama administration and passed last year by Congress.

Over at CATO, Ilya Shapiro can hardly contain his excitement:

In the most important appeal of the Obamacare constitutional saga, today was the best day yet for individual freedom.  The government’s lawyer, Neal Katyal, spent most of the hearing on the ropes, with the judicial panel extremely cautious not to extend federal power beyond its present outer limits of regulating economic activity that has a substantial aggregate effect on interstate commerce.

Now that's more like it.

While I'd love to "hope for some change" here, my enthusiasm was reigned in by this opinion by the inimitable AceofSpades.

There is a certain deja vu quality to these questions from the bench. Tough examination provides cover for later "unexpected" opinions.
