Obama Fails to Stop Arizona From Enforcing the Law
Today, the Supreme Court upheld Arizona's Legal Arizona Workers Act (LAWA). Wait, no -- I must stick to media convention. It's Arizona's controversial Legal Arizona Workers Act (CLAWA).
Quick background: The federal Immigration Reform and Control Act specifically allows states to impose sanctions on people who employ illegal aliens “through licensing and similar laws.” LAWA does just that -- it allows Arizona courts to suspend or revoke the licenses necessary to do business in the state of any employer who knowingly or intentionally employs an unauthorized alien. In its relentless quest to retain the hispanic vote, the Obama Administration sued Arizona for having the temerity to enforce federal law. Sadly, the Chamber of Commerce also joined in the suit.
To quote Hans Von Spakovsky over at Heritage:
Given the lack of political will exhibited in Washington for many years to enforce the federal sanctions against employers who knowingly hire illegal aliens, the implementation by Arizona and other states of these types of substantive state licensing laws is a crucial development. One of the keys to solving the problem we are experiencing with huge numbers of illegal immigrants is making it difficult for them to work. Enforcement of these types of prohibitions is essential to encouraging self-deportation by individuals who are not entitled to be here

That's an awfully controversial decision, Adam. Do we have any idea how the SCOTUS decision broke down?
Oh, and it appears that Goodwin Liu isn't heading for the federal bench. Do you think this has anything to do with your controversial Ricochet post?
Re: Obama Fails to Stop Arizona From Enforcing the Law
It was 5-3, with Ginsburg, Breyer, and Sotomayor dissenting (Kagan recused herself). Breyer made the extremely un-controversial argument that the Arizona law would permit "discrimination [against] legal workers who look or sound foreign."
As for Liu, his nomination did seem to hit the rocks not long after my initial very controversial Ricochet post on his egregious record. Just sayin'.

Good news.
It seems like SCOTUS decisions are a crapshoot every time. Is it any easier for lawyers to predict these judgments?
Re: Obama Fails to Stop Arizona From Enforcing the Law
And Pawlenty is over this and looking more and more like a really good candidate:
This was posted on PJ Media today:
“I applaud the United States Supreme Court in upholding Arizona’s right to do what the Federal government has failed to do and confront the problem of illegal immigration. President Obama broke his promise to address illegal immigration, leaving states and businesses in an untenable situation. As governor, I took aggressive steps towards better enforcement of illegal immigration, but ultimately we need a President who will be serious about fixing America’s immigration system.
“I also am pleased that Justice Elena Kagen properly recused herself from participating in this ruling because of her previous position as President Obama’s Solicitor General, a precedent she must also follow when Obamacare is presented before the court.“
