The Ninth Circuit, the most liberal federal appeals court in the country, today unanimously rejected the lawsuit brought against me by Jose Padilla, who is currently serving his sentence for criminal conspiracy charges as an associate of al Qaeda.  Despite his conviction, he sued everyone involved in his detention as an enemy combatant.  He had already lost in the Fourth Circuit in South Carolina in his lawsuit against Donald Rumsfeld and other Pentagon and military officials who were in charge of the Charleston brig, where he was held.

The Ninth Circuit’s decision confirms that this litigation has been baseless from the outset.  For several years, Padilla and his attorneys have been harassing the government officials he believes to have been responsible for his detention, and ultimately conviction as a terrorist.  He has now lost before two separate courts of appeals, and will need to find a new hobby for his remaining time in prison.

Congrats, John! Haha, I posted about this *before* you did over on the member feed because I heard you interviewed on my car AM radio top of the hour news about it while I was driving around! Now you and Richard need to do a special edition Epstein & Yoo podcast on this to bring us up to speed, so we will know what is going on as the blasting drones take over for the interrogators and as the death penalty is administered when they aren't even sure who is down there. Anyway.  Good work.

And, BTW, in your special edition podcast, could you please address the legal stuff we minions need to know about the drones the news says are going to be tracking us? We are a border state and at this point, the people with their fingers on the drones' triggers have me a little nervous, since they seem to be expanding the situations where they shoot first and don't ask any questions... I would like to hear about that.

Perhaps Mr Padilla will now have time to read Mr Obama's two autobiographies (you know, that talk about his dog-eating and composite girlfriends) - though that might count as torture, which Mr Obama has now banned.
