Over at RealClearPolitics, they've just put up a brief excerpt from today's oral argument that includes a fascinating--and, to those supporting ObamaCare, devastating--observation from Mr. Justice Kennedy.
The excerpt begins with a question to the solicitor general from Mr. Chief Justice John Roberts, the solicitor general launches into an evasive answer, and then, at 44 seconds, Mr. Justice Kennedy interjects. When the federal government tells the citizen he must purchase insurance or face penalties, the Justice says, "that changes the relationship of the federal government to the individual in a very fundamental way."
