For Anyone Who's Still Awake...
The most acute student of the Supreme Court that I know predicts a 6-3 vote to uphold ObamaCare in its entirety. Against which depressing prediction I find myself counterposing the latest on Intrade, which at this hour predicts a "71.9 percent chance" that the Court will strike down the individual mandate.
Whatever the Court announces at 10AM tomorrow morning, ObamaCare delenda est.
And so to bed.

Sleep well Peter. I hope and pray that at least Title I is declared unconstitutional. If not, we'll just have to re-double our efforts to get a Republican House, Senate and President in November. I'll have an anxious night here in Japan, but the consolation is that the verdict will be in when I wake up.

I agree. Kennedy joins the liberals and Roberts piles on to be able to write the decision and limit the damage.

locke91, that could certainly happen, but the Supreme Court has been better at keeping secrets than President Obama’s National Security Council, which makes speculation on the decision very difficult. Via Reuters, I see where Nancy Pelosi feels it will be 6-3 with Roberts joining Kennedy. So, I think we'll just have to wait for the decision.

Conservatives have been beaten up by the SC so often in the decades since the Great Depression, I'm not surprised to see the pessimism.
Yet, I suspect there's going to kill the bill because it so radically alters the Federal government's role in commerce.
Even Ruth Bader Ginsberg has been on record as questioning Roe v. Wade because it went too far too soon (not that I expect her to be consistent with that view in this ruling).

Yeah, I find it hard to believe that Kennedy would take a position that contradicts dominant Beltway opinion. I disagree with those who say he has any core legal philosophy that trumps his need to be in good standing with media center elites.Nevertheless, I wouldn't demand that he resign from the Court, as Hysterical Leftist EJ Dionne wants Scalia to do.

Highlama, that's my feeling too. I think they will reign in the Commerce Clause with a decision in our favor. I would be pleased but not surprised to see Justice Sotomayor join a 6-3 to repeal all or part of the bill.

It is my strong belief that the individual mandate will be struck down.
I also think that the Court will then leave the rest of the bill intact. Thus Congress will be put in the position to either "fix" or repeal the law.
