Is Eric Holder the worst Attorney General ever?  Or just the stupidest?  Or is he some kind of unholy combination of incompetent and stupid?

Item One: His inexcusable botching of the trial of Khalid Sheik Mohammed.  From Richard Miniter's excellent piece in the NYPost:

The Obama administration's fumbling on trials for the 9/11 ter rorists turns out to be worse than anyone realized: It didn't just waste two years trying to hold a civilian trial for Khalid Sheik Mohammed, the confessed 9/11 mastermind -- it set the clock back even further.

Plans by Obama and Attorney General Eric Holder for a trial in New York were always absurd -- even the old Democratic Congress felt obliged to render the move impossible.

But, now that the administration's thrown in the towel on civilian trials, it refuses to just pick up proceedings against KSM back where they left off in the Bush years. Team Obama insists on starting from scratch.

Cmdr. Leslie Hull-Ryde, a Defense Department spokeswoman, confirmed it for me: "The original charges against KSM and his co-defendants were withdrawn and dismissed. In the event charges are sworn and referred against these individuals, the process will start from the beginning, which will be the arraignment.

"Any charges sworn against KSM and his co-defendants and referred to a military commission will not be bound by any motions or rulings made in the previous commission."

Why does this matter? KSM spent nearly two years lodging absurd objections to derail or delay the legal process at Guantanamo.

Item Two: Eric Holder would have prosecuted American CIA personnel and military, for the exact interrogation techniques that led to locating and killing Osama bin Laden.  From Jennifer Rubin's prescient piece from 2009:

Attorney General Eric Holder's decision to ask a special prosecutor to investigate for possible criminal prosecution CIA operatives who interrogated terrorists in overseas locations is the latest and most egregious instance of political gamesmanship by Holder, who strode into office promising to remove the taint of politicization from the Justice Department.
Holder's announcement brought a storm of criticism from senators, former CIA director Michael Hayden, former vice president Dick Cheney, and veteran Justice Department attorneys. CIA employees, already reeling from congressional attacks, were understandably mystified by Holder's words assuring them of his "respect and gratitude" and puzzled as to how naming a special prosecutor could evidence a willingness, as Holder put it, "to look forward, and not backward." Holder's puffing to the effect that all who acted in "good faith and within the scope of legal guidance given by the Office of Legal Counsel" should have nothing to fear is belied by the nature of the investigation, which will examine whether agents really were acting in good faith and correctly applying the OLC's instructions on interrogation.

Eric Holder has to go.  He's not only a terrible Attorney General, but quite literally a threat to national security.

If it were not for the people appointed and nominated by Obama, I'd like him to be king of the world. He is such a visible disaster he pushes fence sitters away from progressives. He's a stronger argument against big government and liberalism than WFB was an advocate for conservatism. Obama is a source of great material for conservative blogs. Rush, Beck et al are funnier with a liberal in the White House, remember how much fun we had with Monica.

I hope Obama generates enough outrage that allows congress to transfer Medicare, Obama Care, Education etc back to the states. Obama wont have to veto the repeal of Obamacare, he just transfers to states (wink wink). He can even be a hero and do that. Obama in office fuels the fire against big gov. We could elect Ronald Regan in 2012 then we lose some unity and urgency.

Too bad Obama can nominate judges and czars. A man with little character can not recognize it in others.Sorry to stray off topic. I apologize. I posted the first line for the sole purpose of stealing the first comment of a Rob Long post.

Eric holder is a craven and malicious malcontent who hates America as we have known her. Remember when he called Americans "cowardly"? That was in February '09, right after the election:

"Though this nation has proudly thought of itself as an ethnic melting pot, in things racial, we have always been and we -- I believe continue to be in too many ways essentially a nation of cowards,"

Holder won't, and says he never will, prosecute the Black Panthers who actively intimidated white voters in Philadelphia. They never denied doing it, never mounted a defense, and it's all on videotape. Holder has instructed his office to ignore all but white-on-black harassment. Some of the AG's best attorneys quit in protest.

The whole Obama administration is guilty of reckless endangerment, implied malice, and depraved indifference. But as long as Americans won't see this, and continue to give him approval ratings 25% higher than what he deserves, we deserve our sad fate.

As I have pointed out, if Obama and Holder had the courage of their convictions, they would have treated all intelligence and evidence obtained by enhanced interrogation, or derived from information obtained by enhanced interrogation, as "fruit of the poisoned tree" and ordered it destroyed so that their counterterrorism efforts going forward were untainted by torture.

Apparently, however, while not caring whether any future President has the benefit of information that could have been extracted since January 20, 2009, Obama has no qualms about taking a seven-year head start on counterterrorism efforts based on information gained by the practices he despises and discontinued.

This suggest that a man of little character can recognize another man of little character. One wonders the limits of the little man of little character.

Again, I apologize for straying off topic. But really! Its Rob Long, lots of people might read this comment, I could be famous. Mom would be proud, I'd better get her a card.

You all are being so judgmental.  I, for one, value diversity in this country and applaud Mr. Obama's AG.  You should look at yourselves in the mirror and ask yourself if you are the change you have been waiting for.  If you are not the change you have been waiting for, I suggest you change immediately.

Eric Holder represents a whole dimension of liberal policy.

I would argue that liberals prize equality above all else. They see government as a mechanism that enlightened elites can use to counter the majority's advantage. Liberal domestic policy is to redistribute wealth so that everyone shares equally. They see their role in foreign policy as a way to restrain America's power so as not to take advantage of "weaker" countries. All of this requires, therefore, a theory of government that restrains the majority and empowers the minority. For all the theory, in practice the liberal legal principle winds up being a weighted bias to the minority.

Conservatives, by contrast, follow the perspective that John Roberts expressed at his confirmation: if the law says that the Big Guy wins, the Big Guy wins. 

So long as Eric Holder is attorney general, the law will place stumbling blocks in the way of the majority -- either as economic regulation or as built-in handicaps on the prosecution. 

So, is the law an equal playing field, or is it tilted against the majority? That's what Holder represents.

Worst ever? I don't know, Janet Reno is tough to top: Waco, Microsoft lawsuit, Richard Jewell leak, Elian Gonzalez, "Third Bomber" evidence in Oklahoma City...Not to say Holder won't get there unfortunately.

He has an anti-capitalist and anti-free market agenda. He is far more than the worst AG; he is the most anti-American AG.

Michele Bachmann tried to play nice earlier last month when she described the Obama administration as merely un- American.

 What happened to a speedy trial?  If you actually believe that this man is entitled to a trial, then he is entitled to a speedy trial.  To hold him without affording him a hearing is wrong.  This is what I dislike the most about this administration.  They prefer form to substance.  If the man is a criminal defendant, then it is an affront to hold him without a trial.  If he is a prisioner of war, then why try him?

I would agree that he is, at least, a bad Attorney General. There were other Attorney Generals before my time that may have been worse. I remember Janet Reno and, as RW Cook says, she was terrible.
