Does Wal-Mart Have a Secret Plan Against Women?
If you're not yet convinced that our legal system is broken, consider this.
Plaintiffs’ lawyers have been trying for almost ten years to certify a sex discrimination class action on behalf of every woman who has ever worked for Walmart. For those of you not steeped in the law, a “class action” is a device to consolidate claims that are essentially identical.
In other words, the lawyers are saying that some 1.5 million women who worked at 1,000s of stores over many years all have the exact same discrimination claim. Could that possibly be true? Sure – if you’re willing to believe that Walmart had a secret master plan to discriminate against women. And communicated the plan to all store managers. And kept it up for years. But of course! I can see it now. Sam Walton gathers together the top brass around the conference table: “Gentlemen, don’t bother me with sales figures! What are we doing to trample on our female employees’ rights?”
Who would believe a thing like that? The New York Times, for one. Back in August, the Times ran an editorial supporting the class action. Not that the newspaper of record did any legal analysis, but simply regurgitated plaintiffs’ lawyers soundbites about giving “the women of Wal-Mart a chance to make their case together.” Good to know that the liberal establishment continues to show knee-jerk support for any frivolous lawsuit -- as long as the suit is against a big, bad corporation.
It's a wonder, is it not, that any foreign company ever sets up shop here.

We see this over and over, yet we still don't get any tort reform. With no scientific data to back it up, I would guess 98 percent of the class action lawsuits are to make money for the lawyers and not to right a wrong.

Since I'm sure we all agree that this Wal-Mart lawsuit is nonsense, I'd like to hear our resident lawyers discuss the viability of tort reform. Is there even a slight possibility that it could happen? If so, how do we achieve it?

Having once taken the job vacated by the guy who moved over to become WalMart's top Human Resources executive, I can tell you that he was as PC and Affirmative Action as it gets.
And having been in human resources for 30 years, I can tell you that no substantial company would ever engage in systematic discrimination on any basis.
We've moved on. The courts have not.

As a former Wal-Mart employee, I can relate a similar sentiment. WM bends over backwards to comply with every compliance issue, no matter how small.
Though it may sound like a crackpot conspiracy theory, I think it's because WM thinks that it can more easily beat its competition by being more of a crony capitalist type business, that is, by complying with gov't edicts more efficiently.

The courts have not, and academics still have courses on the evils of wal-mart.
As someone who competed with them as they rolled across the country and lost , I really respect them . The best thing about Walmart is that they do more to expand the household budget in the country that any one source. Imagine if you could magically deduct 15% from the annual costs of maintaining a household and make that a government program ?
Well, if a family shops at walmart for almost everything ( which is what they carry), their dollar goes 15% further. Walmart provides an invaluable service for the lower and middle class in America.
Now if you can get to the people who rent their apartments by the week, their tvs by the month, buy cigarettes by the each, and their lotto tickets by the handful then you'll be onto something. That is the true face of poverty ( the one that Obama doesn't want us to see).
We need to give Walmart room, inexorably retail markets change with technology. Canute can't stop them.
