Two posts below this one, Dave Carter's third sentence:

The very idea that we sit on the edge of our seats, eyes toward Washington DC, waiting on the deliberations and dispositions of nine mortals to tell us how much of our liberty we get to retain is preposterous.

You know what?  That is the finest, most incisive, and most utterly compelling sentence of commentary about the pending Supreme Court decision on ObamaCare that I've read anywhere--and, like everyone here at Ricochet, I've been reading about it a lot.

Thanks, Dave.  You just said it all.

Nine mortals?

Normally, the 313,500,000+ citizens wait for the views of one man -- Anthony Kennedy.

This country may not be "bleeped", but it's certainly been Borked for almost a quarter century.

Dave Carter

Truth be told, I'd rather write about life on the road. But so much hinges on these decisions, and that fact alone says just how far we've strayed from the nation's founding. Thanks, Peter, but I wish I didn't have to write it, if you know what I mean.

Indeed Mr. Carter is an outstanding author, can't wait to read his posts. I  add this comment to his latest: Every congressman, senator, and president he speaks of were correctly elected and the judges on the Supreme Court properly appointed and sworn in.

Every ounce of liberty that we no longer have is gone because we have given it away, not because it has been taken from us. We have given it away in exchange for promises of pensions, healthcare, central education planning, etc. all of which we falsely believe will be paid for by someone else.

Our next presidential inauguration will take place with our national debt more than $16,000,000,000,000.00. 'They' didn't get us in debt We borrowed that money and surrendered some liberty and sovereignty on our own, no one took it from us.

I'm not waiting with bated breath and I don't think we need to feel like mortals waiting for the decrees of Olympian judges. If they don't rule how we like, we just have to change the law. Let's keep some perspective.

Indeed. We suffer a cancer of the American spirit. I fear both the consequences of leaving it untreated and the treatment. I try not to despair, but there are days I wonder if founding ideals were applicable only to that generation.

Please explain how that will be possible without a filabuster proof majority in the senate? When was the last time a law contrary to liberty was simply changed or repealed?

The fundamental problem seems to be the balance of power is out of balance. Congress is the root of the problem. They are weighted down by self inflicted rules and procedures while at the same time not reading then passing enormous bills.  If Republicans should gain majority in the Senate and keep it in the House, cleaning house should be a priority.  Sigh. Go Tea Party.

Presidents hate congressional gridlock, but very often, congressional gridlock is the luxury safety feature--not the bug. It's just unfortunate that Obama had clear sailing for two years. We'll be paying for that for decades.

There are already a few democratic senators who would vote to repeal Obamacare. Assuming a good outcome for the GOP in the senatorial races this year, it would only require a few more votes. Not to mention that if the GOP gains the White House, it will be able to do all sorts of things to frustrate and thwart the healthcare law, especially since so much of the law is made up of rules and regulations that the HHS creates and enforces.

As far as repealing laws that infringe on liberty goes, what about Prohibition? What about the civil rights act? What about welfare reform? What about every tax cut we've had since Reagan? Heck, what about the repeal of the light bulb regulation? And that's just at the federal level. At the state level you could point to all sorts of efforts that have increased freedom – end of sodomy laws, end of miscegentation laws, end of Jim Crow, passage of right to work laws, end of mandatory collection of union dues, etc. The list is long. If such reform can happen at the state level, it can happen at the federal level as well.

All the doomsday talk and whining about the end of our freedom is just defeatist and over the top demagoguery. If you want a law changed, do the tough grass-roots political leg work to get it done, and stop being a bunch of chicken littles.

Dave is so right in his description.

Good government would see most of the taxes collected in stages from local to federal where the bottom stage collects the bulk and in decreasing amounts as it goes up. Instead we have done the opposite. (This seems to be connected to WWI and WWII and the Cold War.)

A similar thing regarding our laws. The Supreme Court should not have this much sway over the running of our lives. I don't mean that they wouldn't still do what they do but major unsupported laws shouldn't make it out of the many legislative bodies and then the courts wouldn't be so critical in having control of our own country

Dave's observation is brilliant, but then he has an unfair advantage. While he drives he actually thinks about things, while the rest of us just bounce from website to website.

Dave: Tell us you don't surf the web while driving.

This is key, Larry. We are treated by an elected government of our own making exactly as we've requested. I really hate to sound like my mother, but every time you point a finger you have three pointing back at you. We really have no one to blame but ourselves.

I agree to a great extent but the left has gamed the system, too. They are able to have majority control with minority support for way too many years.

So I was wrong, it was was Roberts instead of Kennedy.  Now I know how the troops in the "whack-a-mole" War on Terror must feel some days.

One very sad day for liberty.
